Privacy Policy

Partcloud Inc. (“Partcloud”, “our”, “us” or“we”), respects your privacy and is committed to protecting it through our compliance with this privacy policy (“Privacy Policy”).

Partcloud provides this Privacy Policy to let you know our policies and procedures regarding the collection, use and disclosure of information through partcloud.co (the “Site”), and any other websites, features, applications, widgets or online services that are owned or controlled by us and that post a link to or incorporate the terms of this Privacy Policy (together with the Site, the “Site Services”), as well as any information we collect offline in connection with the Site Services and through other means such as our events, services and marketing activities. This Privacy Policy does not apply to the practices of any third party websites, applications or services that Partcloud does not own or maintain (collectively, “Third Party Services”) formation in any way that it reasonably determines is appropriate.

By using our website or otherwise providing us with your Personal Information (as defined below), you are accepting the practices described in this Privacy Policy, as they may be amended by us from time to time, and agreeing to our collection and use of your information in accordance with this Privacy Policy. If you do not agree to the collection, use and disclosure of your information in this way, please do not provide Partcloud with Personal Information.

What information do we collect?

We collect personal information and non-personal information. Personal information means any information that identifies, relates to, describes, is capable of being associated with, or can be reasonably linked to a particular individual or is otherwise defined as personal information under applicable law. Site Visitors may choose to interact with the Site in a way that results in your providing personal information (PII) to Partcloud, such as giving us your name, email address, phone number, and country location when signing up to learn more about our services or when signing up to apply to be a Partcloud Engineer. If you make use of our Site to register for certain services, attend virtual events or webinars, complete online registration forms, apply for roles via our Site, or to create or update any of your marketing preferences, you may be asked to provide personal information. If you choose to provide us with any PII, we will use the information provided to respond to your request.

If you provide us with your consent to be contacted for marketing purposes, we may send you information about our products and services, including marketing communications, as follows:

  • To market events, promotions, competitions, webinars, reports, our services, news or relevant industry updates.
  • Depending on which country you are in, we may be required to give you an option to “opt-in” and we will always provide you with an option to “opt-out” with each marketing communication.

Partcloud receives technical information when you use our Site or access certain Site Services. We use these technologies to analyze how people use the Site Services and to improve how our Site and Site Services function. We and our third party service providers, including analytics and third party content providers, may automatically collect the following information from you whenever you access or interact with the Site or Site Services: pages visited, links clicked, text entered into contact forms or chat widgets, and mouse movements. We may also collect the referring URL, browser, operating system, and Internet Protocol (“IP”) address you used to access the Site Services. We (and/or our service providers) may use publicly available sources to approximate your geographic region and Internet Service Provider based on your IP address. We collect this information to improve the services we offer you, and to improve marketing, analytics, and the functionality of our Site Services.

How do we use personal information?

Partcloud stores, maintains, processes, and/or handles PII data of employees as necessary to perform its business functions for our employees. We also may receive PII from our Clients to perform services for them. Any PII used for such purposes will be limited to access by only those who require it given their job function at Partcloud and except as otherwise provided herein, we only share the PII back with our respective Clients. Partcloud does not retain, use or disclose any personal information collected on behalf of our Clients for any purpose (including any commercial purpose) other than the specific purpose of performing the services as specified in the applicable Agreement with the Client.

Partcloud may provide PII of our users to only those of its personnel and third-party vendors that (1) need to know such information in order to process it on our behalf or to provide services as described above, and (2) have agreed in writing not to disclose it to any other parties without our consent. You consent to the transfer of information to such individuals and organizations in order to accomplish these purposes.

In some instances, we may be required by law to disclose information you submit or email to us electronically by law, court order, law enforcement request or other purposes to protect our sites or other sites due to security threats. We may, as necessary, disclose this information or any other information that may identify you to state and local authorities or law enforcement as required under law or by court order.

Third parties and transfers?

Partcloud engages third-party resources, applications, and websites. These services provided by third-parties are established to enhance user experience, provide ease of navigation through our site and to promote access to information. We do not buy or sell PII for its business practices or for commercial purposes. Third Party resources are wholly independent from Partcloud and may have separate policies. We (a) have no responsibility or liability for these independent policies or actions; (b) are not responsible for the privacy practices or the content of such websites; and (c) do not make any warranties or representations about the contents, products or services offered on such websites or the security of any information you provide to them. Partcloud may transfer data to third-party vendors acting as our agents, due to an acquisition of business assets by another entity, in the ordinary course of business due to expansions or fund-raising, or as otherwise prescribed by this policy. In the course of any change of ownership, we shall notify any impacted parties in writing of any transfer of PII.

What about children?

Our children are very important to us. We take the privacy of children and students extremely seriously. Because of the nature of our business, our services are not designed to appeal to, and our Site and Site Services are not directed to children under the age of 13. Partcloud does not intend to solicit or collect information and we do not knowingly collect personal information from children under the age of13. Personal information we collect through the site may be subject to the Children’s Online Privacy Protection Act (“COPPA”) and/or the Family Educational Rights. The Children’s Online Privacy Protection Act (COPPA) governs information gathered online from or about children under the age of 13. Verifiable consent from a child’s parent or guardian is required before collecting, using, or disclosing personal information about a child under the age of 13. If Partcloud Site or Site Services intends to collect information about children under 13 years old, instructions and information pertaining to COPPA will be provided by the specific Site Service that collects information about the child. The Site Service will specify exactly what such information will be used for, who will see it, and how long it may be kept. If you believe that a student under13 may have provided us with personal information in violation of this Privacy Policy, please contact us.

What is our security like?

Partcloud uses industry-standard technologies, administrative, technical, and physical measures to protect the security, confidentiality and integrity of any information or data collected by us.

However, no website, service, mobile application, database or system is completely secure or “hacker proof.” You are responsible for taking reasonable steps to protect your personal information against unauthorized disclosure or misuse.

Any changes to our policy

The terms in this Privacy Policy may be changed from time to time, so you should review it periodically for changes. We reserve the right, at any time, to modify or replace this Privacy Policy. The date of the most recent version of the Privacy Policy is noted below under “Effective Date of this Privacy Policy.” We may also notify you via email or other direct electronic communication method of any changes that, in our sole discretion, materially impact your use of our site or the treatment of your Personal Information. Your use of the Partcloud site following the posting of any changes to the Privacy Policy constitutes acceptance of those changes.

These Terms of Use (these ‘Terms’) govern your use of the Partcloud website at www.partcloud.co (the ‘Site’) and the Partcloud no-code solutions for businesses and associated services (collectively the ‘Service’) made available by Partcloud (‘Partcloud’, “we”, “us” or “our”) and the various sites connected to this page.

Termination

Partcloud reserves the right, in its sole discretion and authority, to restrict, terminate, suspend, or otherwise limit these Terms and any access to part or all of our Site at any time and for any reason whatsoever with or without notice or liability.

All appropriate sections including but not limited to Indemnity, Limitation of Liability, Termination, Governing Law and Jurisdiction, and General/Miscellaneous shall survive the termination of these Terms.

Copyright protection

The U.S. Digital Millennium Copyright Act of 1998 (DMCA”) provides recourse for lawful owners of copyright that believe that any material appearing on our Site, or any site, on the internet infringes with their rights under U.S. Copyright law. If you believe in good faith that any materials available on this Site infringe on your copyright, please contact Partcloud directly either yourself or through your agent by mail or email to Partcloud requesting us to remove or block access to such materials. If you believe in good faith that someone has wrongly submitted a notice of copyright infringement against you, DMCA allows you to send Partcloud a separate notice of such a condition. Any notices you submit must meet any statutory requirements as stated under the DMCA.

Governing law & Jurisdiction

These Terms are governed and will construe in accordance with the laws of the State of Delaware, United States of America, without regard to any principles of conflicts of laws or your location. By using our Site, you are agreeing to exclusive jurisdiction in both federal and state courts located in the State of Delaware and you waive any jurisdictional, venue or inconvenient forum objects to such courts.

General/Miscellaneous

Severability

If any one or more of the provisions of these Terms shall for any reason be held by a final determination of a court of competent jurisdiction to be invalid, illegal, or unenforceable to any respect, such invalidity, illegality, or unenforceability shall not affect any other provisions (or portions of provisions) of these Terms, and the invalid, illegal, or unenforceable provisions shall be deemed replaced by a provision that is valid, legal, and enforceable and that comes closest to the intentional express of Partcloud.

Relationship

Your usage of our sites does not establish any relationship between you and Partcloud. You are not an employee, independent contractor, agent, assignee, partner, joint venture, franchise or any other type of fiduciary for Partcloud.

Assignment

You may not assign any part of these Terms, in whole or in part, without Partcloud’s express written consent (which may be withheld or conditioned in Partcloud’s sole discretion).

Construction

Any rule of construction suggesting or requiring ambiguities is resolved against Partcloud shall not apply in the interpretation of these Terms.

Security

Information that is sent electronically or via the internet cannot be assured as completely secured and as such, Partcloud can not guarantee that unauthorized third parties will never be able to access or use electronic data, including your data, or that our security measures cannot be superseded.
